Terms of Service 

xREALM GmbH, Effective: May 01, 2026

§1 Scope and Provider

(1) These Terms of Service ("Terms") apply to all agreements between xREALM GmbH, Kollwitzstr. 76, 10435 Berlin, Germany ("Provider") and customers ("Customer") regarding the use of the "xREALM" service.

(2) The services are primarily intended for consumers within the meaning of Sec. 13 of the German Civil Code (BGB), but may also be used by businesses.

(3) Deviating terms of the Customer shall not apply unless expressly accepted in writing by the Provider.

§2 Description of Services

(1) The Provider offers a platform under the xREALM brand for renting game servers based on a subscription model. Optional add-ons (e.g., backup slots) may be purchased additionally.

(2) Access to the platform is provided via mobile apps (iOS/Android) and via the web (https://xrealm.com). A registered user account is required.

(3) The technical details and requirements for each service are specified on the website and during the ordering process.

§3 Contract Formation

(1) A contract is concluded once the registration process is completed and a paid subscription is booked through the platform.

(2) Payments are processed either through FastSpring as Merchant of Record or directly by the Provider via its payment service providers (Chargebee Pay, PayPal etc.). The applicable option is shown during checkout and in the order confirmation. For orders placed via FastSpring, the contract is concluded between the Customer and FastSpring, subject to their terms. For all other orders, the Provider is the contractual partner; Chargebee Pay and PayPal act solely as payment service providers and do not become a party to the contract.

§4 User Account and Registration

(1) The Customer agrees to provide accurate and complete information during registration and to keep login credentials confidential.

(2) The Provider reserves the right to suspend or delete user accounts in cases of misuse or violation of these Terms.

§5 Customer Obligations

(1) The Customer agrees not to misuse the platform or publish content that violates applicable laws (e.g., copyrighted, harmful to minors, or illegal content).

(2) The Customer must ensure that no unauthorized or harmful activity occurs on their rented servers.

(3) The Customer agrees to indemnify the Provider against all third-party claims resulting from illegal use or content.

§6 Term, Renewal, and Termination

(1) Subscriptions have the duration stated at the time of booking and will automatically renew for the same term unless canceled in time.

(2) Cancellation is possible at any time, effective at the end of the subscription period – via the user dashboard, app, or, for orders placed via FastSpring, directly through FastSpring.

(3) The right to extraordinary termination for good cause remains unaffected.

§7 Prices and Payment

(1) All prices include applicable VAT.

(2) Payment processing is governed by §3 (2). For orders placed via FastSpring, their payment and billing terms additionally apply. For payments via Chargebee Pay or PayPal, the terms of the respective payment service provider apply to the payment transaction only; the subscription itself is governed exclusively by these Terms.

(3) Goodwill refund: Within 3 days of the initial booking of a game server, the Customer may request a full refund of the amount paid without stating reasons. This is a voluntary service by the Provider that exists in addition to the statutory right of withdrawal under §8 and neither replaces nor restricts it. It does not apply to renewals. Requests are made via support or the user dashboard; refunds are issued to the original payment method.

(4) Beyond this, unused subscription periods are refunded only where legally required (in particular under §8 (3) or in the case of a justified extraordinary termination under §6 (3)).

§8 Right of Withdrawal (Consumers)

(1) Consumers may withdraw from the contract within 14 days of its conclusion without stating reasons. The withdrawal instructions and the model withdrawal form are provided during checkout.

(2) The withdrawal must be declared to the respective contractual partner under §3 (2) (Provider or FastSpring).

(3) During checkout, the Customer may expressly request that performance (provisioning of the server) begins before the withdrawal period expires. If the Customer then withdraws, they owe compensation for the service provided up to the time of withdrawal (Sec. 357a (2) BGB). Compensation is calculated pro rata temporis based on the total price of the booked term; the remaining amount is refunded. Without such a request, the server is provisioned only after the withdrawal period has expired.

(4) If the withdrawal is declared within 3 days of the initial booking, the Provider waives the compensation as part of the goodwill refund under §7 (3).

§9 Usage Rights

(1) The Provider grants the Customer a non-exclusive, non-transferable right to use the services during the term of the agreement.

(2) Services are provided solely for private use. Commercial use or transfer to third parties is not permitted.

§10 Availability and Maintenance

(1) The Provider aims to ensure high availability of the services but does not guarantee uninterrupted access.

(2) Maintenance work or technical updates may lead to temporary disruptions. The Provider will announce such interruptions in advance if possible.

§11 Liability

(1) The Provider is liable only for intent and gross negligence. In the case of slight negligence, liability is limited to essential contractual duties (cardinal obligations) and foreseeable damages.

(2) The Provider is not liable for the content or activities on game servers operated by Customers.

§13 Final Provisions

(1) German law applies. If the Customer is a merchant, the exclusive place of jurisdiction is the Provider's registered office.

(2) Should individual provisions be invalid, the remaining provisions remain unaffected.

(3) The contractual language is German. An English version is provided for information purposes only and is not legally binding.
